HIPAA Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

This Notice describes the privacy practices of Starfish Dental Care (“we,” “our,” or “the Practice”). It applies to all protected health information we create, receive, or maintain about you.

III. Our Responsibilities
We are required by law to:
- Maintain the privacy and security of your protected health information (PHI);
- Provide you this Notice of our legal duties and privacy practices;
- Follow the terms of the Notice currently in effect; and
- Notify you following a breach of your unsecured PHI.
We reserve the right to change this Notice and make new provisions effective for all PHI we maintain. Updated Notices will be posted in our office and on our website.
IV. How We May Use and Disclose Your Health Information
We may use or disclose your PHI for the purposes below without your authorization (these are examples, not a complete list):
A. Common Uses and Disclosures
- Treatment: To provide, coordinate, or manage your dental care (e.g., sharing with specialists).
- Payment: To bill and collect payment from you, insurers, or third parties.
- Health Care Operations: For practice activities like quality improvement, training, and audits.
- Appointment Reminders: Via postcard, letter, phone, voicemail, text, or email.
- Treatment Options: To inform you about alternatives or health-related services.
- Family/Friends: To those involved in your care or payment, unless you object.
- Business Associates: To vendors who agree contractually to protect your PHI.
B. Uses and Disclosures Required or Permitted by Law
- Public health activities (e.g., disease reporting);
- Victims of abuse, neglect, or domestic violence;
- Health oversight agencies;
- Judicial/administrative proceedings;
- Law enforcement;
- Coroners, medical examiners, funeral directors;
- Organ/tissue donation;
- Research (with approval);
- To avert serious threats to health/safety;
- Specialized government functions;
- Workers’ compensation.
Substance Use Disorder Records: If we create or maintain records related to substance use disorder treatment (protected under 42 CFR Part 2), more stringent restrictions may apply to their use and disclosure.
V. Uses Requiring Your Written Authorization
Other uses/disclosures (e.g., marketing, sale of PHI) require your written authorization. You may revoke it in writing at any time, except where we’ve already acted on it.
VI. Your Rights Regarding Your Health Information
To exercise these rights, submit a written request to our Privacy Official:
- Access/Copy: Inspect and get copies (electronic if available); reasonable fees may apply.
- Amend: Request corrections if information is inaccurate/incomplete.
- Restrict: Request restrictions (we may not agree, except for certain out-of-pocket payments).
- Confidential Communications: Request alternative contact methods/locations.
- Accounting of Disclosures: List of certain disclosures (first one free per 12 months).
- Paper Copy: Request a paper copy of this Notice anytime.
- Breach Notification: We will notify you of any breach affecting your PHI.
